The Conflict Between Traditional Law and Modern Law
How are traditional law (fiqh) and modern law integrated within legal and political systems?
The fundamental and highly significant issue of the similarities and differences between modern law and jurisprudential law in Iran, especially in the Islamic Republic, provided the occasion for producing a special program in a debate format. This program was held through the efforts of the Iranian Association of Constitutional Law, in collaboration with the Sedanet Cultural Institute and Didarnews media outlet, and with the participation of Dr. Mohsen Borhani and Dr. Hossein Bayat.
This program, produced with Mehdi Yazdanparast as the moderator in a three-way conversation with Mr. Borhani and Mr. Bayat, two jurists and legal researchers, is, as its title suggests, a detailed discussion, examination, and scrutiny of two branches of constitutional law. At least over the past five decades in Iran, the superiority of one over the other has been repeatedly debated, and this verbal conflict will certainly continue.
