In the debate "Moral Boundaries in Legislation," Ardeshir Mansouri and Yaser Roustaei Hosseinabadi address one of the fundamental questions in the philosophy of ethics and law: What is the relationship between morality and law, and to what extent can or should ethics influence legislation?
The conversation begins by defining and distinguishing ethics and law. Ethics is examined as a normative system with internal enforcement, based on praise and blame, while law is tasked with regulating social order and possesses external enforcement. From this perspective, the speakers discuss the shared domain of ethics and law, as well as areas where behavior may be morally reprehensible but not considered a crime by law.
One of the central themes of the debate is the primacy of ethics over law in terms of evaluation and reform. In this discussion, ethics is regarded as a criterion for assessing the justice of laws, and historical examples, from the abolition of slavery to the evolution of the laws of war, demonstrate how shifts in moral sensibilities and judgments can pave the way for legal reform.
Further, the problem of "free riding," the limits of law's power to compel citizens, and the role of ethics in filling legal gaps are examined.
