Lectures on the Philosophy of Law by Reza Beheshti Moez
Reza Beheshti Moez has launched a course based on Jacques Ellul's unpublished lectures on the philosophy of law. The course covers topics such as the normativity of law, the theories of Kelsen and Marx, and the relationship of law to sovereignty, time, and constructedness.
Explanations by Reza Beheshti Moez: Jacques Ellul (born January 6, 1912, in Bordeaux – died May 19, 1994) was a philosopher of theology, politics, law, and technology, a sociologist, a theorist of media and propaganda, and one of the prolific, erudite, and influential figures of twentieth-century French thought. More than sixty works by him have been published to date, and his theoretical innovations and provocative ideas remain striking. Last year, a new work of his was published, consisting of the lectures from his doctoral course in the philosophy of law in the 1970s. In those years, neither the philosophy of law itself as an important branch of knowledge, nor even the leading European figure in this field at the time, “Hans Kelsen,” was widely known or discussed in France. With these doctoral lectures, Ellul opened an important gateway that had remained unpublished until today.
At the suggestion of lawyer and law-student friends from the “Gozareh Circle,” I began a private course on the doctoral lectures in the philosophy of law based on Ellul’s text on Tuesday, the eighteenth of Bahman, 1401, holding a session every two weeks, with the audio file being published, among other places, on the Farhikhtegan Channel. In these lessons, I will not limit myself to Ellul’s text and will, so to speak, deliver advanced lectures on the philosophy of law, but our reference text will be these very doctoral lectures by Jacques Ellul. I hope that upon the completion of the course, the product of these lessons will also be published.

The chapter “Law as a Normative Matter or Prescriptive Order” was examined and explicated through two categories: the significative content of law and its concepts of obligation and punishment, from Ellul’s perspective.

Five legal schools: the democratic will, the historical school of Karl von Savigny, the legal school of Gurvitch, the school of the privileged class, and the legal school of sovereignty (Hegel), were discussed and examined within the framework of the theory of “the group normativity of law.”

تفصیل فرضیه ناحقوقی (بیحقوقی) و بررسی پدیدههای آن
عنوان این فصل مدیون ژان کاربونیه نابغه حقوقی فرانسه در نیمه قرن گذشته است که ژاک الول در درسهای خود آورده است. اصطلاح Non-droit که منِ بنده در این جلسه به ناحقوقی تعبیر کردم (احیا��ا معادل بهتری هم یافت شود) از ابتکارات مفهومی استاد کاربونیه در سال 1956 و در جریان همایشی در دانشکده حقوق دانشگاه استراسبورگ است. این مفهوم در سال بعد یعنی 1957 در جریان مباحث مربوط به حقوق و الغای بردگی شیوع و تداول یافته و دقیقا ناظر به خلاء یا اختفای حقوقی در وضعیت یا مقطعی خاص است.

The crux of this discussion is that law and legislation cannot and should not be a tool for creating legitimacy for political sovereignty. The abuse of law by political sovereignty to pursue specific ends can lead to the exit of citizens from legal universality, and citizens' defiance of a law turned into a plaything can lead to the formation of a hidden legal sphere, which is a kind of social rupture or collapse. But if this deviation occurs, the sovereignty itself is to blame.

The Constructedness of Law and Its Instrumental Role in Managing Time
The problem and concept of time, as a philosophical, physical, and artistic question, has always been central to the reflections of the world's philosophers. The concept of time (whether linear, cyclical, or pendular) must be taken seriously in the craft and construction of law so that law can manage it like a precise instrument.
